Senate Judiciary Committee Approves Data Security Legislation

The Senate Judiciary Committee approved the “Personal Data Privacy and Security Act” (S. 495), sponsored by Senators Leahy and Specter. If a company “reasonably” believes that sensitive personally identifiable information has been accessed or acquired, the bill would require companies to report data breaches. The bill also would (1) give consumers a right to access and correct information held about them by data brokers and (2) impose criminal and civil penalties for those who intentionally conceal a breach that causes economic damage.
